Lost in Translation
If your search on PRC (People's Republic of China) patent
information is conducted in English language based
databases, as much as 95% of the pertinent information may be
missing. Important information for your invalidity or
infringement case may not be obtained from what is lost in
translation. Such mistakes should be avoided.
Unfortunately, most U.S. companies and law firms are simply
not aware of the problem.
Recently, IP Partner conducted
an investigation of a Chinese company's IP portfolio.
A client of IP Partner's was in the decision phase of
acquiring the Chinese company. The client needed
verification that all the inventors' patents were assigned
to the Chinese company. IP Partner found a total of 24
patents that belonged to the Chinese company. This
result was obtained by searching in Chinese on the official
Chinese government's patent site,
http://www.sipo.gov.cn. When the same search was
done in English on the same site, only one patent record
could be found. Similarly, fewer than five records
were found on English based searches using several commercial vendors' sites
including Dialog and Delphion, etc.
The
big difference in the search results shows that much is lost
in translation. In order to obtain accurate and
thorough information on Chinese patents, it is important
that the search is done by a English-Chinese bilingual
patent information analyst. |
